Terms & Conditions:
- This promotional offer is open to any residents who enter into an occupation right agreement (ORA) for a Vivid Living Limited (trading as Vivid Living) independent living villa in our Karaka village, referred to in clause 3 and who comply with the criteria specified in clause 5 below.
- The offer period is valid from 4 May 2026 until 11:59pm 30 June 2026.
- By entering into an ORA for a Vivid Living independent villa at our Karaka location, you are deemed to have accepted the following terms and conditions.
- Any tax obligations arising in regard to receipt of this offer is the entire responsibility of the resident. Vivid Living makes no representation as to the tax liability of the resident participating in this promotion and accepting receipt of the payment. The resident is responsible for any taxes and fees that may be levied or required to be paid by any law or government taxing authority in connection with this promotion. No tax invoice will be issued in respect of any payment made.
- To qualify for the “Winter Boost” promotional offer, you must meet the following criteria:
- have signed an ORA application for a Vivid Living independent villa in our Karaka village by 11:59pm, 30 June 2026 , subsequently sign this ORA, and not cancel this ORA within the 15 Working Day cooling off period (for clarity our Red Beach village is excluded from this offer); and
- paid your deposit in accordance with your ORA; and
- satisfied all your pre-moving in requirements and any conditions set out in your ORA; and
- have a scheduled moved in date for your independent villa that is no later than 30 October 2026 (save where there are delays which result in moving in after 30 October 2026 which are not due to any act, omission, or other default by you under the ORA). For clarity, this promotion does not apply to any villas where the settlement date scheduled by Vivid Living is after 30 October 2026; and
- you have paid the Residence Advance in full, in accordance with the terms of the ORA; and
- you have not terminated your ORA under clause 8.2 (sixty (60) day cooling off period).
- If you meet the criteria specified in clause 5, you will be eligible to receive $15,000.00 paid as a single payment following the end of the 60-day cooling off period as outlined in your ORA under clause 8.2. Payment will be made to your nominated account and can take up to 15 working days to process. The funds may take up to 5 working days to show in the nominated account once the payment has been processed by Vivid Living. For clarity, if the ORA is terminated under clause 8.2 you are not entitled to receive the payment.
- In addition to the $15,0000 cash payment outlined in clause 6, a further payment of an extra $15,000 will be paid at the same time if you settle on or before 30 September 2026.
- Customers must supply a proof of account document in order for Vivid Living to set up the payment.
- Only one promotional offer per signed ORA for an individual villa is permitted.
- Vivid Living’s decision in relation to any aspect of the promotion is final and no correspondence will be entered into.
- Vivid Living reserves the right to vary any of the terms or conditions applying to this promotion or to modify, extend, terminate, suspend or reschedule this promotion.
- Employees of Vivid Living, Fletcher Living and Fletcher Building are eligible for this offer if they comply with the eligibility terms and conditions of this promotion.
- Unless Vivid Living determines otherwise, this promotion is not valid in conjunction with any bespoke Occupational Right Agreement terms and variations, bespoke pricing, or deferred management fee arrangement
- To the maximum extent permitted by law, Vivid Living Limited, trading as Vivid Living, and its related companies, employees and agents, will not be liable for any loss, damage, personal injury or cost (including but not limited to legal and tax obligations, loss of profits, direct loss, indirect or consequential loss) suffered by any person arising directly or indirectly out of or in connection with this promotion or accepting the promotional offer.
- All personal information collected as a result of this promotion will be stored by Vivid Living in accordance with the Privacy Act 2020. Vivid Living may use your personal information to conduct the promotion and may also use this for its own future promotional and publicity purposes.
