Terms & Conditions:

1. By entering into a Occupation Right Agreement for a home that is eligible for this promotion, you (as the resident) are deemed to have accepted the following terms and conditions.

Subject to and in accordance with these terms and conditions, this promotional offer is open to all Vivid Living customers who have signed a legally binding Occupation Right Agreement for the purchase of a License to Occupy a Vivid Living home at our location in Red Beach, Auckland, on these terms and conditions and during the promotion period referred to in clause 2 below. Employees of Fletcher Building are eligible if they comply with the eligibility terms and conditions of this promotion.

2. To qualify for the offer described in clause 3 below you must have signed and entered into a legally binding Occupation Right Agreement to purchase a License to Occupy a Vivid Living home between 18 March 2024 and 30 April 2024 (inclusive), with settlement to occur no later than 27 June 2024 (save where there are delays which result in settlement occurring after 27 June 2024 which are not due to any act, omission or other default by you under the Occupation Right Agreement).

3. If you qualify under these terms and conditions you are eligible to receive $10,000 by way of 12 automatic monthly payments to be processed and commence during the first 10 working days of the month following the date of processing.

4. For clarity, the total payment consists of 12 equal monthly automatic payments for one calendar year; each monthly payment being $833.33 (including GST where applicable). Customers must complete an automatic payment form to confirm their bank account details, and supply a proof of account document in order for Vivid Living to set up the monthly automatic payments. Payments will be made during the first 10 working days of each calendar month and may take up to 5 working days to show in the nominated account. Automatic payment setup forms for sales that satisfy the conditions set out in these terms and conditions will be processed up until the 25th of each month for payment during the first 10 working days of the following month, any automatic payments processed after this date will be processed during the next following month, for payment the month following.

5. Only one promotional offer per signed Occupation Right Agreement for an individual home is permitted. You will be eligible to start receiving the payments once settlement has been completed, subject to and in accordance with these terms and conditions.

6. Vivid Living’s decision in relation to any aspect of the promotion is final and no correspondence will be entered into.

7. Vivid Living reserves the right to vary any of the terms or conditions applying to this promotion or to modify, extend, terminate, suspend or reschedule this promotion.

8. Unless Vivid Living determines otherwise, this promotion is not valid in conjunction with any other promotion that Vivid Living may be running concurrently.

9. To the maximum extent permitted by law, Vivid Living Limited, trading as Vivid Living, and its related companies, employees and agents, will not be liable for any loss, damage, personal injury or cost (including but not limited to your legal and tax obligations and liabilities, loss of profits, direct loss, indirect or consequential loss) suffered by any person arising directly or indirectly out of or in connection with this promotion or accepting the promotional offer.

10. Any tax obligations arising in regard to receipt of the monthly payment are the entire responsibility of the resident. Vivid Living makes no representation as to the tax liability of the purchaser participating in this promotion and accepting receipt of the payments. The purchaser is responsible for any taxes and fees that may be levied or required to be paid by any law or government taxing authority in connection with this promotion, including the purchaser’s receipt of the monthly payments. No tax invoice will be issued in respect of any of the payments made.

11. All personal information collected as a result of this promotion will be stored by Vivid Living in accordance with the Privacy Act 2020. Vivid Living may use your personal information to conduct the promotion and for its own future promotional and publicity purposes. You will have the right to access and request the correction of any personal information held by Vivid Living by contacting Vivid Living in writing at Vivid Living Marketing Department, 810 Great South Road, Penrose, Auckland 1061 or at hello@vividliving.co.nz.
